1. Scope and subject of the contract
1.1. These Conditions govern the relationship between Polignando srls and the Customer with regard to the supply of accommodation end complementary services chosen by the Customer in the booking proposal, made from those offered and viewable on the site https://www.polignando.com or on any other online or offline platform.
1.2 The booking proposal can be made to Polignando srls by: sending an email to [email protected], contacting the numbers on the website polignando.com, through the online booking procedure on the same website or through other platforms that promote and market the accommodation services of Polignando Srls.
1.3 The conclusion of the contract is always subject to the availability of the Service. The confirmation of the conclusion of this contract coincides with the booking confirmation, sanctioned by the sending of an email from Polignando srls to the Customer, (Legislative Decree. n.70/2003), containing these General Contract Conditions and the Policy on the processing of personal data. The booking confirmation email is therefore considered as implicit acceptance of these contractual conditions, (Art. 1326 paragraph 1, Civil Code).
1.4. If the activation of the Services cannot take place due to impediments not attributable to Polignando srls, the contract will be terminated automatically, without any kind of liability of Polignando srls towards the Customer. In this case Polignando srls is required to promptly notify the Customer of the failure to activate the Services.
2. Activation and provision of the Service
2.1 From the moment of activation of the Service Polignando srls guarantees the Customer: furnished housing units, in the number and type defined in the proposal; breakfast (where provided); an equipped kitchen (where provided); Wi Fi internet connection; a bathroom kit consisting of towels and shower gel in numbers proportional to the duration of the stay; room rearrangement for stays longer than 3 nights; linen change, cleaning and sanitization of the accommodation units at each customer change; any other service provided for by national and regional law regarding guest houses and residences.
2.2 Polignando srls reserves the right to provide additional tourist services to its customers, which can be booked directly from the polignando.com website or through the contacts on the same website, depending on availability and length of stay.
2.3 Polignando srls may deliver to the Customer on loan for use any other accessory equipment aimed at the complete use of the chosen Services (keys, cards, tools, etc.).
3. Payment, invoicing and security deposit
3.1 Polignando srls requires the Customer to pay the entire amount at the time of booking, via credit card, PayPal system or bank transfer to the following bank details: Iban: IT22O0846941620000000055033 payable to: Polignando srls; Reason: reservation of [name, surname] for [n. of people] from [day of arrival] to [day of departure], at [name of facility].
3.2 Failure to pay the amount due within the terms referred to in point 3.1 will result in the cancellation of the reservation, unless different agreements between Polignando srls and the Customer.
3.3 If payment is made by bank transfer, the Customer is required to promptly send proof of payment by email to [email protected].
3.4 If the customer requires invoicing, he must expressly request it from Polignando srls no later than Check-in. Otherwise a simple tax receipt will be generated.
3.5 Guests are not required to pay any security deposit, unless otherwise agreed between Polignando srls and the Customer.
4. Duration of the contract, pricing plans, cancellation policies and penalties
4.1 The contract is valid from the moment of booking confirmation and ends if the following conditions are met: the Customer have definitively left the room/apartment; the Customer have paid the entire amount due; the customer has paid any additional amounts due to damage and/or particularly expensive cleaning.
4.2 Polignando Srl offers different tariff plans which are associated with different cancellation conditions:
1) Standard Rate: includes breakfast at a partner bar. Requires prepayment of the amount due at the time of booking as a confirmation deposit. The guest can cancel for free up to 7 days before arrival with only the transaction costs being charged. In case of late cancellation or no show within the day of check-in, the amount paid will not be refunded.
2) Standard non-refundable rate: includes breakfast at a partner bar. Requires prepayment of the amount due at the time of booking as a confirmation deposit. It does not provide free cancellation, therefore in the event of cancellation or no show by the day of check-in the amount of the confirmation deposit will not be refunded.
3) Room only rate: does not include breakfast. Requires prepayment of the amount due at the time of booking as a confirmation deposit. The guest can cancel for free up to 7 days before arrival with only the transaction costs being charged. In case of late cancellation or no show within the day of check-in, the amount paid will not be refunded.
4) Non-refundable Room only rate: does not include breakfast. Requires prepayment of the amount due at the time of booking as a confirmation deposit. It does not provide free cancellation, therefore in the event of cancellation or no show by the day of check-in the amount of the confirmation deposit will not be refunded.
4.3 In case of no show within the day of check-in, the booked room are considered free again and can be booked by other Customers, unless the Customer does not show up, notifies Polignando srls, by the day of check-in, of your late arrival.
4.4 the Customer is required to pay for the entire period initially agreed upon, also for the part of the stay that may not be enjoyed, for reasons not attributable to Polignando srls, if no different agreements have been reached between the parties.
4.5 The Customer must use the rooms/apartments, common areas and equipment not creating disturb to the normal performance of the Service and third parties housed in the facilities. The Customer will be exclusively liable for any damages resulting from the violation of this obligation, holding Polignando srls harmless from any consequences, costs or charges.
4.6 Polignando srls holds an insurance policy for all its accommodation facilities, covering damage to buildings and contents, updated annually;
5. Protection of privacy
5.1 The Customer is informed that the processing of personal data is necessary in order to allow Polignando srls, directly or through third parties, to fulfill the obligations deriving from this contract or for the fulfillment of the obligations established by the Law or the relevant Regulations .
5.2 The data of the Customer and the guests accompanying him are processed in accordance with EU Regulation no. 679/2016 (GDPR) and with subsequent national transpositions and adjustments.
5.3 The data controller is the Legal representative of Polignando srls.
5.4 Further details regarding data processing are reported in the document Policy on the processing of personal data, sent to the customer upon confirmation of the booking, or present in the accommodation facilities and available for subscription;
6. Guest recognition
6.1 Before arriving at the facility, the Customer will be sent a link through which he can, without being obliged, independently enter his and that of the other guests personal data, necessary for the registrations required by current legislation.
6.2 Upon arrival at the facility, or during the customer's stay, each guest must show their valid identification document (Passport/Identity Card/Driving License) to the manager of the facility, to the purpose of personal identification, (Art. 109 Law on Public Security TULPS). Where permitted by current legislation, identification may also be carried out with the aid of IT means, such as facial recognition, video calling or other similar systems.
6.3. Failure to comply with this obligation constitutes a violation of the law and authorizes Polignando srls to request the immediate abandonment of the facility.
7. Responsibilities and limits
7.1 Polignando srls is responsible for breach of contract and provision of the Service exclusively for facts attributable to it.
7.2 Polignando srls is not responsible in the event of delays, inconveniences, malfunctions and/or interruptions of the Service due to unforeseeable circumstances or force majeure, tampering or interventions on the equipment carried out by the Customer, or by unauthorized third parties, damages or inconveniences caused by total or partial interruption of the supply of electricity and/or gas and/or drinking water and/or Wi Fi line, not attributable to Polignando srls.
7.3 Polignando srls declines all responsibility for the loss, theft, and/or damage to objects belonging to the Customer left in the rooms, even if stored inside the safe (where present).
7.4 The Customer will hold Polignando srls harmless from any prejudice, damage, liability, expenses, including legal ones, suffered or incurred, and will also indemnify it from any action, reason, claim made by third parties against it which are caused by behaviors and/or omissions attributable to the Customer, or are a consequence of non-compliance and/or violation of the provisions of this contract.
8. Structure regulations and general information
8.1 Parking: Polignando srls recommends using the public car parks located near the facilities. Upon request, Polignando srls can verify the availability of one or more paid private car parks.
8.2 Check-in/check-out: check-in takes place between 3.00 pm and 8.00 pm. Any arrivals outside of hours must be agreed in advance with Polignando srls. Check-out takes place strictly by 10:00 am.
8.3 Key collection: customers collect the keys at the property and release them inside before checking out;
8.4 Architectural barriers: rooms and apartments are not yet equipped with every design and/or system precaution necessary for those with motor or other disabilities.
8.5 Tourist tax: the tourist tax is equal to 2 euros per person per night, up to a maximum of 7 nights. The tourist tax does not apply to children under 14 years of age. Any other detail relating to the tourist tax is available on the Paytourist portal or on the institutional website of the Municipality of Polignano a mare;
8.6 Children: Le Lamie facility is equipped to accommodate children. Children under 3 years old stay free; Children over 3 years old and up to 12 years old pay an extra rate of 50 euros/night;
8.7 Pets: We are happy to welcome your dogs or cats exclusively at La Lamie on the ground floor, as long as they are small/medium sized and no more than one. If you are accompanied by your pet, you are required to inform us at the time of booking. For the stay of animals a supplement of €20 per night is required. Your animal friends will be under your sole responsibility for the entire duration of your stay. If they are deemed too noisy, dangerous or potentially harmful, Polignando srls may terminate the booking. If your cat is with you, please provide a litter box. Finally, if damage is found or particularly expensive cleaning is necessary, Polignando srls may charge you an additional supplement.
8.8 Breakfast: breakfast is served at partner bars. Each guest is entitled (only in rate plans that include it) to 1 breakfast voucher per day. Breakfast can be consumed no later than 12:00.
8.9 Cleaning: the rearrangement of the rooms takes place every 3 days, or at every change of customer. The rooms must be vacated by 10.00 am to allow for cleaning, otherwise they will be postponed to the following day. Please kindly arrange your belongings to allow for such cleaning. Cleaning the kitchen and dishes before leaving the apartment is the responsibility of the guests. Any extra cleaning must be requested and paid separately. The cost of each extra cleaning is 10 euros.
8.10 Toilets: correct and civil use of toilets is recommended, categorically avoiding throwing any material other than toilet paper into the toilet.
8.11 Waste: all facilities are equipped with recycling bins. Please observe proper waste management during your stay.
8.12 Environmental policies: Customer is asked to close the taps, turn off the lights, the TV and the air conditioners when he does not have to use them.
8.13 Internet: the rooms/apartments are equipped with Wi-Fi Internet service available free of charge.
8.14 Safe: only some apartments in the Le Lamie facilities are equipped with a safe.
8.15 Silence: silence must be observed from 12.00 am to 8.00 am and from 2.00 pm to 4.00 pm.
8.16 Other Guests: it is strictly forbidden to introduce other people into any area of the structure without the manager's authorization, under penalty of a supplement of €250/person. The customer will not be able to sublet or loan the room/apartment, under penalty of termination of the booking fee and a penalty supplement of €250.00.
8.17 Smoking/Weapons/Drugs: it is strictly forbidden to introduce weapons and/or narcotics as well as smoking inside the rooms/apartments and in the common areas, under penalty of immediate termination of the contract.
8.18 Parties: it is strictly forbidden to organize parties inside the rooms/apartments.
9. Dispute settlement clause
9.1 All disputes arising from this Contract will be addressed, in the first instance, in one of the mediation bodies active in the Province of Bari.
9.2 If the Parties intend to appeal to the ordinary judicial authority, the competent Court is that of the place of residence or elective domicile of the Consumer, (art. 33, paragraph 2, letter. u) of Legislative Decree 206/2005).
9.3 Although not expressly agreed, this Contract is governed by the provisions of the Civil Code on contracts in general.
